Termination and Redundancy

The National Employment Standards (NES) detail the amount of notice that must be given by an employer to terminated the employment of an employee.

The provisions contained in the NES are supplemented by the Cleaning Award.

Amount of notice to be given by both employer and employee

Continuous Service Amount of Notice
Less than 1 year 1 week
More than 1 year, but les that 3 years 2 weeks
More that 3 years, but less that 5 years 3 weeks
More than 5 years 4 weeks

In addition, and employer is required to give the employee and additional 1 weeks notice if the employee is over 45 years of age and has had at least 2 year service.

Redundancy occurs where an employer has made a decision that they no lonnger require the job that the employee has been doing to be done by anyone, and is not due to the ordinary and customary turneover of labour.

The NES details the amount of redundancy pay that is payable to an employee if the employer makes the employee redundant.
